1. Acceptance of Terms

By downloading, installing, accessing, or using the KegelCore mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("you" or "the User") and ePhillipe ("we," "us," or "our").

2. Description of the App

KegelCore is a mobile application that provides guided pelvic floor exercise routines for men. The App includes features such as progressive difficulty levels, streak tracking, achievements, haptic feedback, daily reminders, and dark mode support. All exercise data is stored locally on your device.

3. Not Medical Advice

IMPORTANT: THE APP DOES NOT PROVIDE MEDICAL ADVICE.

The content, exercises, and information provided by KegelCore are for general health and wellness purposes only. The App is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

You should:

Consult a qualified healthcare professional before beginning any pelvic floor exercise program, particularly if you have a pre-existing medical condition, have had recent surgery, or experience pain or discomfort.
Seek immediate medical attention if you experience pain, discomfort, or any adverse symptoms during or after using the App.
Not disregard professional medical advice or delay seeking it based on any information or exercises provided by the App.

The exercises presented in the App are based on general pelvic floor exercise principles. Individual results may vary. We make no claims, representations, or guarantees regarding the effectiveness of the exercises for any specific health condition or outcome.

4. User Responsibilities

By using the App, you acknowledge and agree that:

You are at least 12 years of age.
You assume full responsibility for your decision to perform pelvic floor exercises.
You will use the App in accordance with these Terms and all applicable laws.
You are solely responsible for determining whether the exercises are appropriate for your physical condition.
You will stop exercising immediately if you experience pain, discomfort, or any adverse symptoms.
You use the App at your own risk and discretion.

5. Subscriptions and In-App Purchases

The current version of KegelCore is free to use with no in-app purchases or subscriptions required.

In future releases, the App may offer auto-renewing subscriptions to unlock premium features. If subscriptions are introduced, the following terms will apply:

Pricing and availability will be displayed within the App before any purchase is made.
Payment will be charged to your Apple ID account (iOS) or Google Play account (Android) upon confirmation of purchase.
Auto-renewal: Subscriptions will automatically renew at the end of each subscription period unless you cancel at least 24 hours before the end of the current period.
Cancellation: You may cancel your subscription at any time through your device's subscription management settings.
Refunds: Refund requests are handled by Apple (for iOS purchases) or Google (for Android purchases) in accordance with their respective refund policies.
Free trials: If a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription.
Price changes: We may change subscription prices from time to time. You will be notified of any price changes in advance.

6. Intellectual Property

All content, features, and functionality of the App — including but not limited to the design, text, graphics, logos, icons, exercise routines, audio cues, animations, and software code — are the exclusive property of ePhillipe or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not:

Copy, modify, distribute, sell, or lease any part of the App.
Reverse-engineer, decompile, or disassemble the App.
Remove any copyright, trademark, or other proprietary notices from the App.
Use the App to create a competing product or service.

7. Limitation of Liability

      The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
    

We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant that the exercises provided will produce any specific health outcomes or results.

In no event shall ePhillipe, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages; any loss of profits, data, use, goodwill, or other intangible losses; any damages arising from your use of or inability to use the App; or any damages arising from any injury, illness, or health condition related to your use of the exercises provided by the App.

Our total aggregate liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim, or fifty US dollars ($50.00), whichever is greater.

8. Indemnification

You agree to indemnify, defend, and hold harmless ePhillipe, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses arising from or related to your use of the App, your violation of these Terms, your violation of any applicable law, or any injury or health issue you sustain while using the App.

9. Disclaimer of Health Claims

We expressly disclaim any and all health-related claims. We do not claim that pelvic floor exercises will treat, cure, or prevent any disease or medical condition. We do not claim that the App is suitable for all individuals. We do not guarantee any specific results from using the App. The App has not been evaluated or approved by the FDA or any other regulatory body.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

11. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you through the App or by updating the "Last Updated" date. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict-of-law provisions.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not in a class, consolidated, or representative action.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ePhillipe regarding your use of the App.
